1. General Provisions

These General Terms and Conditions (hereinafter: Terms) regulate the rights and obligations between ANNE STUDIO obrt za usluge i trgovinu (hereinafter: Seller) and you, the customer (hereinafter: Buyer), regarding the purchase of products through the online store annebeauty.shop. By accessing our website or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.

3. Orders, Pricing, and Contract Formation

All products are subject to availability. A contract is formed when we send you an order confirmation email. We reserve the right to refuse any order at our discretion. All prices are displayed in EUR and include Croatian VAT (25%) where applicable. Prices are subject to change without notice, but changes will not affect orders already confirmed. We make every effort to ensure pricing accuracy; however, if an error is discovered, we will inform you and allow you to proceed at the correct price or cancel the order.

4. Payment Terms

We accept payment via credit/debit cards (Visa, Mastercard, Maestro) processed securely through Stripe, and bank transfers for orders within Croatia. Full payment must be received before dispatch. All transactions are in EUR. By providing payment information, you represent that you are authorized to use the payment method. We are not responsible for any fees charged by your bank or card issuer.

5. Shipping, Delivery, and Risk Transfer

We ship within Croatia and the European Union only. Delivery times are estimates and not guaranteed. The risk of loss or damage transfers to you upon delivery to the carrier. We are not liable for delays caused by carriers, customs, or circumstances beyond our control. Please inspect packages upon delivery and note any visible damage with the carrier immediately. 6. Right of Withdrawal (14-Day Return)

In accordance with EU Directive 2011/83/EU and Croatian Consumer Protection Act (Zakon o zaštiti potrošača, OG 41/14, 110/15, 14/19), consumers have the right to withdraw from the contract within 14 days of receiving goods without giving any reason. To exercise this right, notify us by email at info@annebeauty.shop with a clear statement. You must return the goods within 14 days of notification at your own expense. Products must be unused, in original sealed packaging, with all tags attached. We will refund all payments (excluding delivery costs if you chose express shipping over standard) within 14 days of receiving the returned goods.

7. Exclusions from Right of Withdrawal

Pursuant to Article 79 of the Croatian Consumer Protection Act, the right of withdrawal does NOT apply to: (a) goods that have been opened, unsealed, or used (for hygiene and health protection reasons, this applies to all cosmetic products); (b) goods made to the consumer's specifications or clearly personalized; (c) goods that deteriorate rapidly or have a short expiry date; (d) sealed goods that cannot be returned for hygiene reasons once opened after delivery. By opening a cosmetic product, you acknowledge you forfeit the right to return it.

8. Legal Warranty and Liability

All products come with a legal warranty for material defects (2 years for consumers) as required by Croatian Obligatory Relations Act (Zakon o obveznim odnosima). We are liable for defects existing at the time of delivery. For complaints about defects, contact us within 2 months of discovering the defect. Our total liability under any order is limited to the purchase price paid for the specific products. We are not liable for indirect, incidental, or consequential damages, loss of profits, or any damages arising from improper use, allergic reactions, or failure to follow product instructions.

9. Product Information and Disclaimer

Product descriptions, images, and specifications are for informational purposes and may slightly vary from actual products due to manufacturer changes or screen display differences. Colors shown may differ due to monitor settings. We recommend performing a patch test before using any new cosmetic product. We are not liable for allergic reactions; customers are responsible for checking ingredients. Product results may vary. Promotional material is not a guarantee of specific outcomes.

10. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, photographs, product descriptions, and software, is the property of ANNE STUDIO obrt za usluge i trgovinu or its licensors and is protected by copyright and intellectual property laws. Unauthorized use, reproduction, or distribution is prohibited. Product brand names and logos are trademarks of their respective owners.

11. Privacy and Data Protection

Your personal data is collected and processed in accordance with our Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR) and Croatian Data Protection Act. By placing an order, you consent to the processing of your data as described in our Privacy Policy.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, strikes, government actions, carrier delays, or supply chain disruptions.

13. Amendments to Terms

We reserve the right to modify these Terms at any time. Changes take effect upon posting to the website. Your continued use of the website after changes constitutes acceptance of the modified Terms. The Terms applicable to your order are those in effect at the time of placing the order.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Croatia. Any disputes shall be resolved by the competent courts in Čakovec, Croatia. For EU consumers, disputes may also be submitted to the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. Before initiating legal proceedings, parties agree to attempt amicable resolution through direct communication.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
